The Health of Nations INC may suspend or discontinue the provision of the Service on the WEB for any reason whatsoever, without prior notice, including for any maintenance of the website or repair of equipment.

3. PRICES.

Unless otherwise stated on the website, all prices are included insurance of the goods, local delivery charges, and applicable taxes.

4. PAYMENT.

Terms of payment are within The Health of Nations INC sole discretion unless otherwise agreed to by the Company. Payment must be received by The Health of Nations INC before the Company acceptance of an on-line order. Payment will be made by credit, debit card or another on-line payment system.

5. SHIPMENT.

Any shipping date shown represents The Health of Nations INC best estimate as of this date, but the Company shall not incur any liability of any kind whatsoever for failure to deliver on any particular date unless the firm delivery date has been expressly agreed to by an officer of the Company in a separately signed written instrument. Claims against The Health of Nations INC for patent defects, or errors must be made in writing to the Company e-mail within seven days of receipt of the goods, or such claims shall be deemed to have been waived.

6. CHANGING OR CANCELING ORDERS.

6.1. Customer may change the details of or cancel an order by contacting The Health of Nations INC by telephone and e-mail or through the WEB. Notwithstanding the preceding, The Health of Nations INC., reserves the right not to accept cancellations because of nature, type, quantity or shipping date of Products, the distribution system used, or other relevant factors.

6.2. If a Cancellation is made through no fault of The Health of Nations INC., there may be a restocking charge or a production cancellation charge as provided for in the Cancellation Policy. These fees are applied to offset the costs incurred by the Company for handling and/or production work already performed.

6.3. No Cancellations or returns can be accepted if Express Service is requested at the time of the order.

6.4. No Returns can be taken if seven days passed from the date of delivery.

7. RETURNING AND REPLACING PRODUCTS.

7.1. If a return or replacement is requested through no fault of The Health of Nations INC, there might be a handling or restocking charge.

7.2. The Customer may require return or replacement of Products to The Health of Nations INC unless any of the following cases applies:

(a) The Products are not designated as “Stock” in the Catalogue.

(b) The Products have deteriorated or been damaged by Customer except as otherwise provided in these Terms and Conditions.

(c) The Products that the Customer wishes to return because of the Customer’s preferences such as the Products not suiting the Customer’s tastes (having a different colour or appearance from that in Catalog).

(d) The Products that have marks or damage attributable to the Customer.

(e) If seven days have passed since the date of delivery of the Products.

7.3. If a Product contains any Defects attributable to The Health of Nations INC., the Company will replace or accept a return of such Product. The Health of Nations INC will pay for reasonable delivery costs incurred in replacing such Product.

8. GOVERNING LAW.

The transaction with respect to the goods which are the subject of this online sale shall be governed by and interpreted in accordance with the legislation of the State of New York, and an action arising out of such transaction shall be brought exclusively in courts seated in the New York or the Federal District Court, and Customers agreement to such exclusive jurisdiction and venue is a condition of sale.

9. LICENSE TO USE WEBSITE.

9.1. You may:

(a) view pages from our website in a web browser;

(b) download pages from our website for caching in a web browser;

(c) print pages from our website;

9.2. Except as expressly permitted by Section 9.1 or the other provisions of these terms and conditions, you must not download any material from our website or save any such material to your computer.

IN NO EVENT SHALL THE HEALTH OF NATIONS INC., OR THE MANUFACTURING AND SELLING COMPANIES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, OR OTHER FINANCIAL LOSS ARISING OUT OF, RELATED TO, OR IN CONNECTION WITH THE PRODUCTS, WHETHER OR NOT CAUSED BY OR RESULTING FROM THE NEGLIGENCE OF THE HEALTH OF NATIONS INC., OR ITS AGENTS, UNLESS SPECIFICALLY PROVIDED HEREIN.

IN NO EVENT, SHALL THE HEALTH OF NATIONS INC LIABILITY HEREUNDER OR OTHERWISE ARISING ABOUT THE SALE OF THE PRODUCTS EXCEED IN ANY EVENT OR UNDER ANY THEORY OR CAUSE OF ACTION, THE PURCHASE PRICE PAID BY THE CUSTOMER TO THE HEALTH OF NATIONS INC FOR THE PRODUCTS.

13. COMMUNICATION WITH THE HEALTH OF NATIONS INC.

The Customer is requested to place orders, give notifications and make any other communications regarding transactions to The Health of Nations INC during the regular business hours of The Health of Nations INC set out in the Catalogue. The Customer is also requested to contact The Health of Nations INC regarding any problems with the Products or other technical consultations.

14. CONSULTATION.

Any matters not provided for in these Terms and Conditions must be dealt with in agreement with the spirit of these Terms and Conditions and further discussion between The Health of Nations INC and the Customer.
